Terms of Service

1. What BARB is

BARB is appointment-booking software for service businesses. It provides each business with a public booking site and a dashboard for managing services, staff, availability, customers, and appointments. These terms are between BARB and the business that creates an account ("you").

If you are a customer booking an appointment with a business that uses BARB, your agreement is with that business, not with BARB. These terms do not govern that relationship.

2. Free beta, and no uptime guarantee

BARB is currently offered free of charge during a beta period. There is no service level agreement and no uptime guarantee. The service may be unavailable, may lose recent changes, or may change substantially at any time.

Do not use BARB as the only record of information you cannot afford to lose. Export your data periodically. We will give reasonable notice before ending the beta or introducing charges, and you will never be charged without agreeing first.

3. Your account

You are responsible for the accuracy of your account details, for keeping your credentials secure, and for everything done through your account — including by staff you invite. Staff access can be revoked by the account owner at any time.

4. Your content and your customers' data

You keep ownership of everything you put into BARB: your business details, the content of your public site, and your customer records. You grant BARB only the permission needed to host and display that content and to operate the service for you.

You are responsible for:

  • the lawfulness of the customer data you upload or enter, including having a lawful basis to hold it and to contact those customers;
  • obtaining any consent required before sending reminders by email or text;
  • the content you publish on your public site, including that you have the rights to any images you upload;
  • responding to your own customers' requests to access, correct, or delete their data.

In data-protection terms, you are the controller of your customers' data and BARB is your processor. See the Privacy Policy.

5. Acceptable use

You may not use BARB to:

  • break the law, or facilitate anyone else doing so;
  • send unsolicited marketing, or contact people who have asked you to stop;
  • upload content that is unlawful, infringing, or that you have no right to publish;
  • attempt to access another business's data, probe or interfere with the service's security, or place a deliberately excessive load on it;
  • resell or white-label the service without written permission.

6. Suspension and termination

You may stop using BARB and close your account at any time. On closure, your data is deleted as described in the Privacy Policy; export anything you want to keep first.

We may suspend or terminate an account that breaches these terms, that is being used unlawfully, or where continuing to host it puts the service or other users at risk. Where circumstances allow, we will warn you first and give you an opportunity to export your data. Suspension takes a business's public booking site offline immediately.

7. Disclaimer of warranties

BARB is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that it will preserve any particular piece of data.

8. Limitation of liability

To the fullest extent permitted by law, BARB will not be liable for any indirect, incidental, special, consequential, or exemplary damages, nor for lost profits, lost bookings, lost revenue, or lost or corrupted data, arising out of or relating to your use of the service.

Because the service is currently provided free of charge, our total aggregate liability to you is limited to [LIABILITY_CAP].

Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.

9. Changes to these terms

We may update these terms. If a change is material we will update the date at the top and notify account holders by email. Continuing to use the service after a change takes effect means you accept the updated terms.

10. Governing law

These terms are governed by the laws of [JURISDICTION], and the courts of [JURISDICTION] have exclusive jurisdiction over any dispute arising from them.
